Public charitable
donation offer
This document sets out the terms for voluntary one-time and recurring donations to the Foundation.
1. General provisions
1.1. This document is a public offer by Charitable Organization “Oltera Foundation” (the “Foundation”) to enter into a charitable donation agreement with any individual or legal entity (the “Donor”). The Foundation’s name on the website is Oltera Foundation.
1.2. The offer is published on the Foundation’s website at the Foundation’s website (the “Website”). It takes effect on the publication date and remains in force until withdrawn or replaced by a new version.
1.3. These terms are prepared in accordance with the Civil Code of Ukraine, including its provisions on donations, and the Law of Ukraine “On Charitable Activities and Charitable Organisations.” The same terms apply to all Donors.
1.4. The Donor should read the offer before transferring funds. By accepting it, the Donor confirms that they understand its terms and act voluntarily.
2. Subject of the agreement
2.1. The Donor transfers funds to the Foundation without charge as a charitable donation to support charitable activities in accordance with the Foundation’s charter, this offer and the purpose of a specific fundraiser, if the Donor chooses a restricted donation.
2.2. The Foundation accepts the donation and uses it for the charitable purposes set out in section 4. A donation is not payment for goods or services and does not provide the Donor with consideration.
2.3. The Donor independently chooses the donation amount. The technical rules of the chosen payment service may set a minimum or maximum amount.
3. Acceptance and date of agreement
3.1. Acceptance means an action that clearly shows agreement with the offer: selecting the donation confirmation button and completing a payment through a payment service available on the Website, or transferring funds to the Foundation’s official account with a charitable payment purpose stated.
3.2. The agreement is concluded when funds are credited to the Foundation’s account or the Foundation receives confirmation of successful crediting from the payment service. For donations made through a third-party platform, the time of crediting is determined by that platform’s rules and the actual receipt of funds by the Foundation.
3.3. Donations may be one-time or recurring if the chosen payment service offers that feature. Recurring charges are made only with the Donor’s separate consent in the service interface. The Donor may stop future recurring charges using the procedure provided by that service.
4. Fundraising purpose and use of donations
4.1. General donations are used to achieve the Foundation’s statutory purposes, including support for children and families in need in education, healthcare, humanitarian assistance, safety, development and community recovery.
4.2. Restricted donations are used for the purpose described on the relevant fundraiser page or in the payment purpose. If the Donor does not specify a purpose, the donation is treated as general.
4.3. The Foundation may provide assistance directly to beneficiaries or purchase goods, works or services needed for the relevant charitable programme. The Foundation records donations and expenses and publishes information about its activities as required by law and its internal documents.
4.4. Administrative costs needed to operate the Foundation and implement charitable programmes are incurred in accordance with the law and may not exceed the limit established by law.
4.5. If it becomes impossible to use a restricted donation for its stated purpose, the Foundation acts in accordance with the law and the terms of the specific fundraiser. Where possible, the Foundation seeks the Donor’s agreement to change the purpose; this offer does not establish an automatic redirection of a restricted donation.
5. Rights and obligations of the parties
5.1. The Donor may choose the amount, an available transfer method and, where available, a specific fundraiser; receive confirmation of the donation; ask the Foundation how the donation was used; and monitor the restricted use of a donation to the extent provided by law.
5.2. The Donor must provide accurate information where needed for payment and use only payment instruments they are authorized to control.
5.3. The Foundation must accept and use donations in accordance with the law, its charter, this offer and the purpose of a restricted fundraiser; maintain proper records; and consider Donor enquiries.
5.4. The Foundation is not responsible for delays, refusals or fees imposed by a bank or third-party payment service. That service’s own rules govern payment processing.
6. Mistaken transfers and refunds
6.1. The Donor may request a refund if a payment was made by mistake, more than once or without their consent. The request should include the date, amount, payment method, available transaction identifiers and a contact for the reply. Do not send a full payment card number, CVV/CVC code or password.
6.2. The Foundation reviews the request and, if the refund is confirmed and does not conflict with the law or payment service rules, returns the funds using the same method or agrees another available method with the Donor. The refund period also depends on the bank or payment service rules.
6.3. A voluntary charitable donation is not payment for a product or service. A donation properly made and used or designated for a charitable purpose is not refunded except where required by law or agreed by the Foundation after reviewing the circumstances.
7. Personal data
7.1. The Foundation processes personal data the Donor voluntarily provides during a payment or enquiry only to the extent needed to process the donation, confirm payment, respond to an enquiry and meet legal requirements.
7.2. Payment card data are processed by the bank or payment service. The Foundation does not receive or store full card details unless the payment service provides them to the Foundation.
7.3. Personal data processing, data subject rights and the responsible person’s contact details are set out in the Foundation’s separate Privacy Policy at Privacy Policy.
8. Enquiries, changes and final terms
8.1. For donation enquiries, the Donor may contact the Foundation at info@oltera.foundation or by phone at +38 095 917 36 97. To help locate a payment, include its date, amount and transaction identifier where available.
8.2. The Foundation may amend this offer by publishing a new version on the Website. Unless the law provides otherwise, the version in force when the donation is made applies.
8.3. Ukrainian law governs the parties’ relationship. If a provision of the offer is held invalid, the remaining provisions stay in force.
8.4. This offer does not confirm that any payment service has been connected. A donation through a specific service is possible only after the Foundation publishes a verified payment link or account details.
